Terms and Conditions (Revision October 3, 2024)

1. Acceptance of Terms
By downloading, installing, and/or using the Handy Bros App (hereinafter referred to as "the App"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App or live video and chat features.

2. User Accounts
- Single Account Limit: Each user is limited to one account. Creating multiple accounts by the same individual is strictly prohibited.
- Accurate Information: You agree to provide true, accurate, current, and complete information about yourself during the registration process. 
- Prohibition of False Information: The use of false information or impersonating another person through your account is strictly prohibited.
- Authorization for Others' Information: You must not use another person’s information without their explicit written consent. We reserve the right to request and verify such consent.

3. Prohibited Conduct
You agree not to use the App for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use and enjoyment of the App.

Users are prohibited from using abusive, inappropriate, or vulgar language during live video sessions or other communications with Handy Bros representatives. Any violation may result in immediate termination of services and potential account suspension, and, where necessary, legal action.

4. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, unless otherwise stated, are the exclusive property of Handy Bros. Home Comfort Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5. Hold Harmless Clause
You agree to hold harmless, defend, and indemnify Handy Bros. Home Comfort Inc., its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, resulting from or arising out of your use or misuse of the App, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

6. Limitation of Liability
To the fullest extent permitted by applicable law, Handy Bros. Home Comfort Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the App;
- Any unauthorized access to or use of our servers and/or any personal information stored therein;
- Any interruption or cessation of transmission to or from the App.

7. Termination
We reserve the right to terminate or suspend your account and access to the App, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Changes to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to the new terms taking effect. You are responsible for regularly reviewing these Terms for updates. Any changes to the Terms will become binding 30 days after the release date. Your continued use of the App after any such changes constitutes your acceptance of the updated Terms.

9. Live Video Features

Handy Bros. Home Comfort Inc. may provide a Live Video feature on its website or mobile app to facilitate direct communication between users and Handy Bros. Home Comfort Inc. representatives. By accessing or using the Live Video feature, you agree to the following additional terms:

User Responsibility: You acknowledge that your use of the Live Video feature is at your sole discretion and risk. You agree not to engage in any inappropriate, illegal, or harmful behavior during the use of the Live Video service, and you will not record or disseminate any portion of the video sessions without express written permission from Handy Bros. Home Comfort Inc.

Service Limitations: The Live Video feature is provided "as-is" and "as available," and Handy Bros. Home Comfort Inc. reserves the right to modify, suspend, or terminate this service at any time without notice. Handy Bros. Home Comfort Inc. shall not be liable for any interruptions, delays, or failures in the Live Video service due to technical issues or other circumstances beyond its control.

Data Usage and Privacy: Use of the Live Video feature may require access to your device's camera, microphone, and other relevant permissions. Handy Bros. Home Comfort Inc. values your privacy and will handle all personal data collected during the Live Video sessions in accordance with our Privacy Policy. However, Handy Bros cannot guarantee the security or confidentiality of communications over the internet.

Limitation of Liability: Handy Bros. Home Comfort Inc. shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to the use of the Live Video feature, including but not limited to personal injury, property damage, loss of data, or technical malfunctions.

Privacy Agreement

1. Information Collection
We collect personal information that you provide to us directly, such as when you create an account, update your profile, or communicate with us.

2. Use of Information
We use the information we collect to:
- Provide, operate, and maintain the App;
- Improve, personalize, and expand our services;
- Understand and analyze how you use our App;
- Develop new products, services, features, and functionality;
- Communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the App, and for marketing and promotional purposes;
- Process your transactions and manage your orders;
- Provide transactional and order statuses.

3. Information Sharing
We do not share your personal information with third parties outside of this agreement except as necessary to provide the App services or as required by law.
Your personal information may be shared with the following third-party vendors:
Zoom Video Communications, Inc. – Required for use of our live video chat support and other messaging supports.
ServiceTitan, Inc. – Required for use of various functions within the App, including but not limited to displaying past order information, membership status, etc.

4. Data Security
We implement appropriate technical and organizational measures to protect the security of your personal information. However, please be aware that no method of transmission over the Internet, or method of electronic storage is 100% secure. Rest assured; we use military grade encryption to protect sensitive data.

5. User Rights
You have the right to access, update, or delete the information we have on you. You can do this directly within your account settings or by contacting us.
Some information may not be changed after signup.

6. Account Closure
You have the right to request account closure at any time.
Account closure requests can be made in the App, or by written request via email.
Handy Bros. Home Comfort Inc. reserves the right to deny account closure for any reason except where required by law. Upon successful account closure, Handy Bros. Home Comfort Inc. may keep record of the email on account to prevent future signups by the same email as necessary.

7. Changes to This Privacy Policy
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. You are advised to review this Privacy Policy periodically for any changes.
